TERMS AND CONDITIONS OF SALE
1. Introduction
This document sets out our general terms and conditions of sale (GTC).
These conditions apply to all sales concluded on the "ANJALI MUDRA" site with the customer in accordance with the Belgian Code of Economic Law.
The customer acknowledges having read and accepted the GTC prior to placing the order. The validation of the order is therefore considered as acceptance of the GTC.
Please read these terms and conditions carefully, as well as our general terms and conditions of use, our cookie policy and our privacy policy before using the site.
2. Identification of the company
The "ANJALI MUDRA" site, publicly available through the WIZ platform at the website address www.anjalimudra.be, is managed by Mrs. Charlotte Laffineur, a natural person registered with the Banque Carrefour des Entreprises under the number 0755451737, having her registered office at Grand-Place Baudouin 1er n17, 1420 Braine-l'Alleud, Belgium.
3. Order
No contract can exist between you and the company until an order has been expressly placed by you and accepted.
If you wish to place an order on our site, you must select the product(s) you wish to order and add them to your "Shopping Cart" and then validate the contents of your "Shopping Cart".
If you have a customer account, please identify yourself and validate your delivery address.
If you do not have a customer account, please provide all the essential information required to place an order, namely your first and last name, your e-mail address and your delivery address.
Before placing an order, you must read and accept these terms and conditions of sale; otherwise, no order can be placed.
At the end of the purchase process, you will be invited to proceed to the payment of your order.
Before that, a summary will allow you to check the details and the amount of your order. Please correct any errors before accepting your order.
Once you have confirmed payment, you will receive an email acknowledging receipt of your order and listing the order details.
4. Delivery
We deliver in Belgium and in France, Luxembourg, Germany, Netherlands, Spain.
We deliver to relay or access point (choosen by us) near the address indicated by the Customer.
We choose the following mode of delivery: Bpost and UPS to ensure a good and safe delivery of the orders.
Our shipping costs in Belgium are 5€ VAT included. The delivery costs are indicated in the summary of your order, before you place it. Shipping cost is offered in Belgium for a purchase above 160€.
In order to keep our carbon footprint low and our production close to the buyer, we do not ship outside Europe.
We estimate the delivery time within Belgium to 3-4 working days. For other EU countries, we estimate time between 5-8 working days.
In the product description and in the summary of your order, we specify the estimated time before you place your order.
Delays may occur for reasons related to product customization, unforeseen circumstances or delivery area.
If such delays should occur, we will notify you on the email address provided.
Delivery will be considered to have been made at the time you or a third party designated by you takes physical possession of the products.
5. Price and payment
The price of the products is the one indicated on the site.
The price displayed includes VAT but excludes delivery charges which are added to the order, it being understood that the delivery charges will be communicated to you before proceeding with the order.
You can make the payment with the following credit cards: Paypal, Visa, Mastercard, Apple pay, Klarna, American Express, Bancontact and Bancontact QR Code.
6. Legal right of withdrawal
In accordance with Belgian law, you have the right to withdraw from the contract within 15 days from the date on which you or a third party designated by you took physical possession of the delivered products.
To exercise your right of withdrawal, you can send us the form below, completed, be e-mail to the following address: hello@anjalimudra.be.
The right of withdrawal is respected if you notify us of your withdrawal before the expiry of the 14-day period.
Please note that it is important to return the product(s) in the same condition as received and in the original packaging.
a) Effects of the right of withdrawal
If you decide to withdraw from the contract, you will be responsible for the return shipping costs.
We will refund all payments made, including, if applicable, the cost of delivery to the original place of delivery within 14 days of being informed of your decision to withdraw from the contract.
However, we reserve the right to postpone the refund until the product(s) is (are) recovered.
We will make the refund using the same method of payment that you used for the original transaction.
b) Exception to the right of withdrawal
Your right of withdrawal cannot be exercised in the case where the contract concerns the delivery of product(s) made to your specifications (per example : pieces from the serie "perfectly imprefect" or the delivery of product(s) sold with a discount.
7. Exchange
If you consider that the product is not in conformity with your order, please contact us immediately via the following e-mail address: hello@anjalimudra.be.
We will examine the returned product and inform you by e-mail if the product can be refunded or replaced. The replacement or refund will take place within a maximum of 14 days from the date of sending the said e-mail.
If a return due to a defect has to be made, we will make the refund in the same manner as the original transaction, including the shipping and return costs.
8. Legal warranty
You benefit from the legal guarantee established in favor of consumers which cannot legitimately be excluded, namely the legal guarantee of conformity stipulated in articles 1649 bis to 1649 octies of the Belgian Civil Code.
We shall be liable for any lack of conformity that exists at the time of delivery of the product(s) and that appears within two years of the delivery of the product(s).
If a return due to a defect has to be made, we will make the refund in the same manner as you used for the original transaction, including the shipping and return costs.
9. Responsibility
We are not responsible for possible small differences in color, size or quality between the product photographed on the site and the product delivered knowing that every product is unique.
All possible differences, of any nature whatsoever, are generally tolerated by commercial practice for this type of product.
No cancellation of order, compensation and exchange can be required in the cases mentioned above.
10. Complaints

11. Intellectual property
The company has the only right to have the intellectual property rights on the products, services, images, and any other creation marketed by it.
No order or sales contract can be assimilated to a transfer of intellectual property rights or to a license.
12. Personal data
We process your personal data in accordance with the EU Regulation 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation or "GDPR"). Please take note of our "Privacy Policy" and "Cookies Policy" in this regard.
13. Applicable legislation and competent courts
The purchase contracts concluded on our site are governed by Belgian law, without prejudice to any other legislation protecting the consumer that may be applicable to the transaction in the Member State of the European Union where you are located.
In the event of a dispute that cannot be resolved amicably, any dispute relating to an order will be subject to the jurisdiction of the Belgian courts, without prejudice to the right of consumers in the European Union to address a court closer to their domicile.

14. Final Provisions
Our failure to enforce any provision of these terms and conditions at any time shall not be construed as a waiver of such provision at a later time.
If any provision of these terms and conditions is held to be invalid or unenforceable, it shall be deemed to be unwritten, without affecting the validity of the remaining provisions, unless the provision held to be invalid or unenforceable was material and controlling.
